Company Faces Hefty Penalties Following A Fatal Crane Collapse

The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) initiated an investigation into a construction contractor based in Texas. The inquiry followed a tragic incident at a work site in March 2023, where a 23-year-old employee lost their life due to a crane collapse during the construction of a metal building.

The investigation unveiled that the company had failed to follow essential safety procedures while operating a mobile crane, directly resulting in the tragic crane collapse. OSHA cited the company for several willful and serious violations that put the employees at significant risk.

Some of the willful violations included operating the mobile crane beyond its rated capacity, not using temporary alternative measures when the load and radius cell malfunctioned, and compelling the crane operator to exceed the crane’s rated capacity.

Prevention is Critical

Furthermore, the construction contractor was cited for serious violations, including a lack of accident prevention programs, infrequent inspections of the work site, and failure to meet federal safety standards regarding crane inspections and wire rope inspections.

The penalties proposed by OSHA amount to a staggering $262,977, underscoring the gravity of the violations committed by the company. Timothy Minor, OSHA Area Director in Texas, emphasized the dire consequences of disregarding safety standards, particularly in operating heavy machinery like cranes.

Conclusion

This incident serves as a stark reminder to business owners in the construction industry, highlighting the need for strict adherence to safety protocols. Neglecting safety standards not only puts employees at risk but also attracts substantial financial penalties. Employers must prioritize the safety of their workers, ensuring they operate in a secure environment to avoid tragic accidents that can have lasting and devastating impacts on individuals, families, and the company as a whole. Safety should always be a non-negotiable priority for every business.
