Plumbing Company Employees Denied Overtime 

The DOL investigation revealed that two plumbing companies failed to pay their employees the appropriate overtime rates for hours worked beyond 40 in a workweek, a violation of the Fair Labor Standards Act. 

One of the two plumbing companies neglected to include pre-and post-shift hours worked, on-call pay, and non-discretionary incentive bonuses in the regular rate for overtime calculations. On the other hand, the other plumbing company failed to include commissions in the regular rate when computing the half-time premium due to overtime workweeks. 

The Consequences 

To rectify these violations, the DOL recovered significant amounts in back wages and damages from the offending employers. One of the two plumbing companies was required to pay $59,111 in back wages to 25 workers, along with an equal amount in liquidated damages. The other plumbing compnay had to pay $2,323 in back wages to 10 employees.
