Company Denies 15 Employees Overtime Wages 

The findings of the Wage and Hour Division revealed that an HVAC company had denied overtime wages to 15 employees, directly violating their rights as per the Fair Labor Standards Act (FLSA). The company knowingly paid regular rates instead of the mandated time-and-a-half rates for overtime hours, demonstrating a clear disregard for the law. Due to the flagrant nature of these violations, the division imposed civil money penalties totaling $5,000 on the employer as a punitive measure.

The recovery included $84,540 in overtime back wages and an equivalent amount in liquidated damages for the 15 affected employees. This significant restitution underscored the impact on workers who were deprived of their rightful compensation. 

Terence Trotter, the Wage and Hour District Director in Hawaii, emphasized the legal obligation of employers to accurately compensate employees for all hours worked, particularly stipulating time-and-a-half pay for hours exceeding 40 in a workweek.
