Ensuring a safe and compliant workplace is of paramount importance for every business, regardless of size or industry. The U.S. Department of Labor (DOL) recently highlighted the consequences of failing to address safety hazards within the workplace. An engine component manufacturer, faced penalties totaling $298,000 after a follow-up investigation revealed recurring safety violations that resulted in a worker’s finger amputation in March 2022.

Manufacturer Faces Penalties Following 16 Repeat Violations

The Occupational Safety and Health Administration (OSHA) conducted a follow-up investigation in March 2023 after a worker’s hand was caught in a polishing machine that lacked required machine safety guards. This incident underscored the need for businesses to promptly address safety concerns and take appropriate measures to prevent accidents and injuries.

The follow-up investigation revealed two repeat violations related to improperly adjusted bench grinders and the failure to post 2022 OSHA injury and illness logs as required. Additionally, OSHA identified 14 serious violations, including hazards associated with a spray booth, unguarded projected shaft ends, belts, and pulleys on a horizontal lathe, air compressors operating at unsafe pressure levels, and electrical equipment usage beyond safe limits. The company also used extension cords instead of permanent wiring, exposing workers to electrical risks.

The Ramifications

OSHA proposed penalties totaling $127,187 for the identified violations during the follow-up inspection. Furthermore, failing to abate citations were issued to the engine component manufacturer for not correcting previously identified hazards and failing to include a 2022 recordable injury on its OSHA 300 log. Despite an agreement with OSHA to address the violations, the company did not provide abatement documentation. Consequently, an additional penalty of $171,063 was imposed for failing to remedy the 2022 violations.

In total, the company faces a substantial penalty of $298,250. This case serves as a clear reminder to businesses that overlooking safety regulations can lead to severe financial penalties and, more importantly, endanger the well-being of employees. Prioritizing workplace safety through prompt correction of hazards and compliance with safety standards is essential for any responsible employer.

Conclusion

Fostering a culture of safety within the workplace is a fundamental duty for every business owner. Adhering to safety regulations and addressing identified hazards promptly not only safeguards the workforce but also mitigates legal and financial risks. Businesses must stay proactive in ensuring compliance with safety standards and take appropriate actions to create a safe work environment for all employees. Compliance with safety regulations is not only a legal requirement but also a moral obligation to protect the lives and well-being of those contributing to the success of the business.
