In a decision that will obligate employers to implement COVID-19 protocols starting January 10, 2022, the 6th U.S. Circuit Court of Appeals has lifted the stay on the federal government’s directive that companies collect documented proof of employee vaccination status or require weekly testing.
Unless the Supreme Court intervenes, this Emergency Temporary Standard (ETS) will apply to all businesses with at least 100 employees.
The standard indicates that employers must “establish, implement, and enforce a written mandatory vaccination policy.”
OSHA has provided a policy template.
OSHA has stated they “will not issue citations for noncompliance with the standard’s testing requirements before February 9, so long as an employer is exercising reasonable, good-faith efforts to come into compliance with the standard.”
